Civil litigation is the trial of civil matters for remedies permitted under civil law. It's generally distinguished from criminal proceedings, where a defendant is charged by the state with violating a criminal statute. In civil cases, guilt or innocence typically isn't the issue — the question instead is whether a defendant is liable for damages or another remedy under common law or civil statute.
The Law Office of David M. Kennedy, P.C. represents both plaintiffs and defendants in civil court. Arbitration clauses are increasingly common in contracts, and when a dispute is bound for arbitration rather than a courtroom, the Firm is prepared for those proceedings as well. Mediation is required by the courts in nearly every civil case, and beyond representing hundreds of clients through mediation, David is a trained mediator who has been retained by other attorneys to mediate their own clients' disputes.

The Firm typically represents the victims of civil wrongs — David M. Kennedy does not represent insurance companies. That said, in cases where insurance isn't involved, David will represent defendants in civil suits as well. When he does, he's often able to identify grounds for a counterclaim — helping a client not only defend and defeat the claim against them, but become the plaintiff and recover in their own right.
